Today a story on housingwire.com about class action lawsuits against Lender Processing Service, Inc, (LPS) makes reference to a case filed in Bourbon County, Kentucky involving the counter-suit in a residential foreclosure. That case, Wells Fargo v. Sexton, pending before Division II of the Bourbon Circuit Court, involves the foreclosure and foreclosure processes involved with the Sexton’s home. For the last two years the Sexton’s have faced foreclosure by a trust that does not exist. The Sextons are represented by Nick Wooten, lead counsel of all the cases listed in the housingwire article, and Brian Canupp, attorney and some time blogger.
